RENTAL AGREEMENT & POLICIES

 

PAYMENT SCHEDULE: If you booked through our website, VRBO/Homeaway, Flipkey, or any other site where Knutson is a merchant of record, A Deposit of $200 towards the balance of the reservation is required at the time of booking. The balance including taxes and any other applicable fees is due 90 days prior to your arrival date. If you booked through Airbnb, Expedia, Redawning or any other portal where that company took your payment, you adhere to their payment policies. 

OWNER RESERVATION PAYMENT SCHEDULE: If the reservation was booked with the owner of the property & on the owners advertising page, their reservation payment schedule will supersede any other payment schedules.

CANCELLATION POLICY:  Cancellations made ninety (90) days or more prior to arrival with written notice shall not be responsible for the final balance of the reservation. The $200 deposit made at the time of booking is non refundable after the booking is made. . Cancellations of less than ninety (90) days prior to arrival shall forfeit the entire rent and excise tax (less cleaning fees) unless we are able to re-rent the property. Refunds on any forfeiture will be issued the dollar value the unit is re-rented for during the same dates as the canceled reservation. There is no refund for early departure or no shows.

 If you booked through Airbnb, Expedia, Redawning or any other portal where that company took your payment, you adhere to their cancellation policies. 

OWNER RESERVATION CANCELLATIONS: If the reservation was booked with the owner of the property & on the owners advertising page, their cancellation policy will supersede any other cancellation policies.

Alteration Fee: A $50 alteration fee will be added to your reservation (per change) of date or property. Alterations are allowed only before final payment is made or 90th day prior to check in. Fee will be applicable to all reservations after 24 hours upon booking creation. Fee is non refundable once applied. 

 

CHECK IN

Check in time is 4:00pm or later. Bring your check in instructions and final confirmations. Keys are located directly at your Vacation Rental in a lockbox at the property or a door code will be provided if the property has an electronic lock. Access codes will be sent by email when the reservation is paid in full & the rental agreement is signed. Our normal business hours are: 9:00am – 5:00pm, Monday Through Friday. Contact# is 808-329-1010. We are closed weekends and holidays. For after hours emergencies, call 808-987-9295. 

CHECK OUT

Check out time is 11:00 am or earlier. 

Requirements: Please ensure all dishes are washed and remove all trash from the property. Please turn off all small appliances, lights, fans and air conditioners(if applicable). Secure all doors and windows. If the property you reserved uses keys for entry access, please put one key in the lockbox, and all other entry/pool keys on the counter. If your property was provided with a door code, please just ensure doors are locked when you leave & ensure any applicable pool keys are left on the counter. Our Housekeeping team will take care of the rest. If you ignore these check out instructions, it is understood, agreed & accepted there will be additional charges applied to the credit card on file.

LATE CHECK OUT/EARLY CHECK IN. 

Late check outs & Early Check ins must be authorized in advance and will be approved upon availability. There are fees that apply. If your party checks in early or stays after checkout time you will be charged accordingly. 

PROPERTY CONDITION

Knutson & Associates, has the right to inspect the property without prior notice at any time to enforce the terms of this rental agreement. If any guest or tenant violates any terms of this agreement, Knutson & Associates has the right to terminate the rental agreement. The property is privately owned and has many personal items of the owners. Please be considerate of such items. . The guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The guests shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. 

IF YOU GET LOCKED OUT

If you should get locked out, a spare key may be borrowed from our office during business hours. If assistance is required after business hours, there will be a $100 charge payable at the time of the assistance directly to the agent that assists. We suggest leaving a key inside the lockbox each time you leave.

THEFT/INJURIES/DAMAGE TO GUESTS PERSONAL BELONGINGS 

Upon acceptance of this agreement, guests will not hold Knutson & Associates or Owner of property liable for any injuries, damage or theft of any guests or visiting guests personal belongings that take place in the unit. 

 

 

MAINTENANCE

Please report any equipment failure to us immediately. We reserve the right to enter your Vacation Rental during your stay for repairs with 24 hours notice, and without notice in the event of an emergency.

CONSTRUCTION

Construction at areas surrounding your Vacation Rental is beyond our control. We do not offer refunds, relocations, or discounts for construction. If there is excessive noise beyond normal working hours, we will attempt to contact the construction site manager regarding working hours.

BUGS

Paradise comes at the price of dealing with bugs. They are common & almost unavoidable here in the tropics. 

Common pests include but are not limited to; Cockroaches, Centipedes, Moths, Nats, Ants, Spiders & geckos. 

However, there are steps that can be taken to help you avoid them as much as possible.

  • Always keep all food and beverages stored properly & sealed

  • Keep surfaces clean & take out trash daily. 

Routine insect spraying is part of life in the tropics. If treatment is scheduled during your stay, a notice will be posted in advance. Remove garbage daily and store all food in containers. You will need to supply your own trash bags above & beyond the starter supply amount.

If you have a safety or medical emergency, please dial 9-1-1. For any emergencies concerning your reservation or Vacation Rental, Please call us at 808-329-1010. If it is an after hours emergency, please leave a message at 808-987-9295.

 

 

 

 

DAMAGE PROTECTION PLAN OR SECURITY DEPOSIT

Every booking with Knutson & Associates directly is required to purchase a damage protection plan at the cost of a 1 time $49.00 fee; if you choose not to purchase the Damage Protection Plan, a $1000 Security Deposit must be provided instead. If you have purchased your Damage Protection Plan through CSA Travel Protection when booking the reservation, that is acceptable as well. Please provide our office written proof of the policy that would be emailed to you upon making your reservation.

 If you booked your reservation directly with the owner of the property through an Owners Private Airbnb/VRBO Page & they do not require you to purchase a Damage Protection Plan, then this requirement is waived based upon the owners discretion.  Our Damage Protection Plan will be automatically added to all reservations unless the registered guest contacts our office to arrange for the Security Deposit provision.  OR has indicated they have purchased their Protection Plan through CSA, OR has the exception through the owner of the property  This needs to be addressed with our office when final payment is due for the reservation.

The damage protection plan will cover unintentional damages to the rental unit interior, including real or personal property of the unit that occurs during your stay up to a $1000 maximum provided that this is disclosed to Knutson & Associates Management prior to check out. The damage protection plan will cover the registered guest for the cost of repair or replacement of such property up to a maximum of $1000.00.

Text: 808-987-9295 The registered guest must report any loss or damage to the property or its contents immediately to Knutson & Associates Management. The damage protection plan is considered void if the damage is not reported prior to check out. All you have to do is report any damage before you leave & we will complete the claim on your behalf. Prompt action may allow us to lessen the damage. (Especially spills on carpet or furniture). Any damages that exceed $1000 will be charged to the credit card on file. The card holder hereby authorizes Knutson & Associates to apply these charges to his/her account. The Damage Protection Plan is subject to the conditions, terms and administrative procedures listed below. 

 

CONDITIONS OF PROTECTION FOR DAMAGE PROTECTION PLAN 

The Damage Protection Plan will not include liability for damage or theft resulting from

1. Intentional acts of the registered guest or other registered guests

2. Negligence or willful conduct 

3. Any cause if the registered guest does not report the damage to Knutson & Associates Property Management Staff

4. Damages caused by any pet or other animal brought onto the property

5. The renter is evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by the resort or property.

6. Additional expenses and/or cleaning due to smoking in the property or lanai, contraband, Homeowner association fines for breaking of any rules or unpaid accrued charges during the stay.

 

TERMS OF THE DAMAGE PROTECTION PLAN

1. This damage protection plan takes effect at the time of check in.

2. All coverage shall terminate upon the registered guests check out time of the property or the departure of the guest, whichever occurs first.

AIRBNB/EXPEDIA AFFILIATE/REDAWNING BOOKINGS: If the reservation was booked directly on Airbnb/Expedia/Redawning Affiliate listing sites, The reservation is pre paid through these affiliate sites & Knutson & Associates will not collect any additional funds from the renter, unless there is Damage/Missing items found from the renters departure. Renter agrees to pay us directly for any damage that Knutson & Associates determines is caused by Renter's actions. 

 

SECURITY DEPOSITS

You may choose a $1,000 Security Deposit in lieu of the Damage Protection Plan. The Security Deposit needs to be paid by personal check, cashiers check, bank transfer, or money order payable to "Knutson & Associates" & needs to be received when final payment is due for the reservation. 

 If you booked your reservation directly with the owner of the property through an Owners Private Airbnb/VRBO Page & they do not require you to provide a Security Deposit, then this requirement is waived based upon the owners discretion. The owners 

 Address to send the check to is 75-5782 Kuakini Hwy#C-2B & C-2D Box C-4, Kailua Kona, HI, 96740. Please note in the memo of the Security Deposit check the first and last name on the reservation, & the word 'Security Deposit'. For bank transfer information, please ask our management staff for further information. If a security deposit has been provided, these funds may be applied to actual damages or missing contents caused by the registered guest or guests of the registered guests. This is at the sole discretion of the Knutson & Associates Property Management inspector; the property will be reviewed on the day of the Guest’s departure, or the next business day. This may include excessive cleaning charges, excess services requited, moving furniture that does not get returned to its original location, fines imposed and/or costs for enforcing this agreement. Within 14 days following the end of the tenancy the Security Deposit will be applied, accounted for or refunded to the registered guest. Guests shall report any damage noted upon arrival to avoid any Security Deposit losses. If you do not report the damage to us during your stay, and our inspection team has to report it to us after your departure, guests understand, agree & accept that the damage is considered their responsibility and they will be charged accordingly.  The refund will be mailed to the address listed on the reservation within 14 days of departure. At the sole discretion of the Knutson & Associates Broker In Charge, this security deposit is refundable if all terms of the agreement are met, and will be forfeited if the guidelines or policies are breached or broken.

The Security deposit is fully refundable within the timeframe of (14) days after departure, provided the following criteria is met.

1. No damage is done to the property or its contents, beyond normal wear and tear.

2. All debris, rubbish and waste are placed in proper trash receptacles. Soiled dishes must be placed in the dishwasher.

3. All keys must be left in the clear site at the property and the unit is left locked.

4. No smoking has occurred in the unit. (Outside smoking is acceptable in designated areas).

5. No existing personal items or linens that belong to the property are lost or damaged.

 

 

 

 

 

CREDIT CARD AGREEMENT

I am providing my credit card number as a guarantee of payment to KNUTSON & ASSOCIATES. I agree to pay all rent and charges related to property rental. I accept all terms of the rental agreement and accept all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear during the term of my rental agreement with KNUTSON & ASSOCIATES. I understand, accept & authorize Knutson & Associates to charge the registered card on file if the charges exceed any applicable Security Deposits. If I have elected to purchase a Damage Protection Plan in lieu of the Security Deposit, I understand, accept and authorize Knutson & Associates to charge the registered card on file if the damages don’t meet the terms & conditions of the Damage Protection Plan. In the absence of another payment arrangement, I authorize KNUTSON & ASSOCIATES to charge my credit card for payment of these items.

 

LOSS OF PERSONAL BELONGINGS 

The property owners or Knutson & Associates are not responsible for loss of personal belongings or valuables of guests. We advise you not to bring expensive jewelry and other expensive belongings to your Vacation rental. Do not leave personal belongings in your car or on the beach unattended. If you leave something behind, and insist on us mailing it back to you, there will be a $100.00 service fee and the cost of postage applicable to you. 

CLEANING

This unit is professionally cleaned before and after each stay by an independent cleaning service. It is always our #1 priority to ensure the place is cleaned exceptionally well. In the event that you’re not satisfied with the cleaning upon your arrival, please notify our office immediately. You can call us at 808-329-1010 or 808-987-9295, so we can send the cleaning staff back to the property to address whatever needs to be done to your satisfaction. Housekeepers will not go back to the property to clean if guests do not report any issues to us within 24 hours of arrival. 

 

SUPPLIES

There is a starter pack of supplies. This is not intended to last the duration of your stay. This is only a starter pack. The starter pack consists of the following: A small amount of laundry detergent, bath soap, 2 rolls of toilet paper per bathroom, 1 paper towel roll, 1 dish sponge, starter supply of dish soap, 1 trash bag.  Grocery stores are conveniently located nearby. We offer grocery & shopping services for you prior to your arrival; fees may apply. You may also use helpful smartphone apps such as Instacart & Doordash which are available on the island. 

PETS AND SMOKING

None of our Vacation Rentals allow pets OR smoking in unit OR the lanai. Please smoke outside to avoid damages and extra cleaning charges. If there is evidence of smoking or pets found, there is a fee of up to $1000.00 charged to the renter. 

 

MAXIMUM OCCUPANCY

Each property is individually owned, and owners' individual maximum occupancy will be strictly enforced. It is a requirement to register the total number of adults & children in this rental agreement who are staying at the Vacation Rental Property. Any guest staying in the vacation rental property above and beyond the registered number will be considered a direct violation of the agreement. This will result in an additional fee of $100 per night per person and additional penalties may apply. 

 

 

AIR CONDITIONING

The Vacation Rental Property you reserved may or may not have AC. Please be diligent in inquiring if your property has AC or not. If AC is present at the property, please use it conservatively to help keep utility costs down as AC units are expensive to operate. If the AC is left on excessively it is subject to freezing (damaging the unit) and/or possible excessive condensation, which may cause leaks into other units. Please be mindful to turn AC off when gone or if not necessary. If the Air Conditioner is found left on after your departure, fees might be applicable. 

GARBAGE DISPOSALS

If the property you rented has a garbage disposal, they are only to be used for small food remnants left on dishes. Anything other than small food particles will cause the device to become jammed. If the device becomes jammed/damaged, and there’s evidence of misuse, the cost for the repair/and or replacement will be your responsibility. Please call Knutson & Associates at 808-329-1010 for further clarification on proper use. 

STORAGE OF GUEST ITEMS

Guests are NOT to store bicycles, scuba/diving gear, inflatable rafts, water toys, or any other outdoor items inside the units. These items can be stored on the Lanai or in guests' cars. Towels and other gear may not be draped over the railings or visible from any other properties in the complex. These are due to the house rules of the complex that are strictly enforced by on-site management.

 

PARTIES/SPECIAL EVENTS

Written consent must be obtained from agents for any special events, including parties.

KEYS/REMOTE CONTROLS 

Keys to the premises are the exclusive property of Knutson & Associates. There will be a minimum charge of $50 for replacement of each lost key and a $100 charge for lost remote controls.  

MAIL BOXES & SCREEN DOORS

We do NOT have mailbox keys for the property you rented. Do NOT send your mail to the property address. If you must receive mail during your stay, send it to our office address at 75-5782 Kuakini Hwy#C-2D, BOX C-4, Kailua Kona, HI, 96740. If you send your mail to the property address by mistake, you will be responsible for calling a locksmith & paying for the service to obtain the mail. We do NOT provide keys to screen doors. Do NOT lock the screen door, as you will be responsible for any costs associated with calling a locksmith out to the property, in the event you lock yourself out using the screen door. We only provide front door keys. 

 

ENTRY & INSPECTION

Knutson & Associates retain the right to enter the premises in accordance with State Law; A. In case of emergency, without prior notice. B. To make necessary repairs, alterations, improvements, supply necessary or agreed services. In the case of a repair that is not emergency related, Knutson & Associates will contact guests for permission to enter should no one be available at the time of repair. Repairs will await your permission or your departure.

 

TERMINATION OF OCCUPANCY 

Upon termination, the Guest will: (1) vacate the property completely as well as any parking or storage areas in use by the Guest; (2) leave keys in the unit, (3) leave remote controls and garage door openers in the unit, (4) leave all furnishings in the same condition as received. Knutson & Associates retains the right to immediately terminate the tenancy if the Guest is in violation of any part of this agreement and risks a minimum $200 fine.

MANAGEMENT

We do NOT manage any of the Condominium Complexes. We have NO control over closed facilities, complex improvements, or pest control.

 

WAIVER OF LIABILITY 

KNUTSON & ASSOCIATES acts as a marketing and rental agent for homeowners, suppliers and contractors. Under no circumstances shall KNUTSON & ASSOCIATES be responsible for any loss, expense, damages, claims, or injury, direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of your use of the Property or of any delay(s) substitution(s), rescheduling(s) or change(s) in the provision of services or accommodations by KNUTSON & ASSOCIATES or its agents, employees, owners and/or subcontractors.

RENTERS LIABILITY

Renter accepts the premises in their present condition. Renter agrees to be fully responsible for said premises, while premises are in Renters care.. Renter agrees to and takes full responsibility of the ‘House Inventory’ in the property they rented. ‘House Inventory’ are personal belongings or any items in the unit/home. Renter shall be cautious of the Property Owners belongings. Renter agrees to not make any alterations, additions, repairs or improvements and/or any removal of owners personal property from the premises without Knutson & Associates written permission. The Renter also agrees to fully accept the liability of his/her negligence or any negligence caused by a family member or guest of the Renter. The Renter agrees to immediately notify Knutson & Associates if an infraction of the agreement occurs with regards to damage or personal items missing. The Renter agrees to pay Knutson & Associates for any damage in excess of any applicable security deposits. Renter will pay any reasonable attorneys fees and court costs, if any, incurred by the Agent or Owner in enforcing this contract in court or otherwise to recover costs of damage.

 

STVR RULE 23/BILL 108 RENTAL CONTRACT REQUIREMENTS FOR HAWAII COUNTY

All Vacation Rental Renters need to comply with the following for all STVR properties:

(A)Quiet hours shall be from 9:00 p.m. to 8:00 a.m., during which time the noise from the STVR(short term  shall not unreasonably disturb adjacent neighbors.

(B) Sound that is audible beyond the property boundaries during non-quiet hours shall not be more excessive than would be otherwise associated with a residential area.

(C) Guest vehicles shall be parked in the designated onsite parking area.

(D) The STVR shall not be used for commercial purposes.

CHOICE OF GOVERNING LAW & TAX CHANGES FROM STATE OF HAWAII. 

This Agreement will be governed by the laws of the State of Hawaii, applicable to Agreements made and fully performed in Hawaii, by Hawaii residents. Any action relating to this agreement shall only be instituted and prosecuted in courts in Hawaii. Guests specifically consents to such jurisdiction and to extraterritorial service of process. Guests understand & acknowledge Taxes from the State of Hawaii may change at State of Hawaii's discretion. The State of Hawaii may increase GE or TAT Tax, and Guest agrees to pay the difference in Tax should the State implement this change. 

 

 

 

 

 

AGREEMENT TO INDEMNIFY

KNUTSON & ASSOCIATES, in its sole and unrestricted discretion, reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodation or guest services. Rates may be subject to change. You agree to hold KNUTSON & ASSOCIATES harmless from any liability or expense arising from your use of the property, including use by all occupants, invitees, and others, and you further agree to indemnify KNUTSON & ASSOCIATES for all claims, costs, expenses, including attorney’s fees, and/or damages incurred by KNUTSON & ASSOCIATES, its agents, employees, successors and assigns, , directly or indirectly, as a result of your use of the property including use by all occupants, invitees, and others, or your breach of this agreement.

 

PRIVACY POLICY   Knutson & Associates respects the privacy of every individual who uses our website. We only process and use the data obtained through this site for the specific purposes you've authorized for your transaction, based on the rental agreement for your reservation. We do not sell customer information to third parties.
